About Connecticut Form CT-8857

Connecticut Form CT-8857 is used to request innocent spouse relief, separation of liability, or equitable relief from Connecticut income tax, penalties, and interest. Use the form when you filed a joint Connecticut return for the year or years listed on the request and you believe only your spouse or former spouse should be held liable.

Do not file Form CT-8857 with your Connecticut income tax return. The PDF includes Parts 1 through 7, a questionnaire, an explanation sheet, general instructions, specific instructions, mailing instructions, and signature fields. A complete request must answer all questions in Part 6 and be signed and dated in Part 7.

Do not use Form CT-8857 when your joint refund was, or is expected to be, applied against your spouse's past-due debt such as child support. Use Form CT-8379 to request the nonobligated spouse share of a joint Connecticut refund.

When should I use 2025 Connecticut Form CT-8857?

Use Form CT-8857 as soon as you become aware of a Connecticut income tax liability for which you believe only your spouse or former spouse should be held responsible. Do not file Form CT-8857 with your Connecticut income tax return. Mail the completed request and any required statement separately using the address in the PDF instructions.

What is Connecticut Form CT-8857 used for?

Use Form CT-8857 to request Connecticut innocent spouse relief, separation of liability, or equitable relief. The request can involve Connecticut tax, penalties, and interest from a joint return when you believe the liability should belong only to your spouse or former spouse.

Who should use Form CT-8857?

Use Form CT-8857 if you filed a joint Connecticut income tax return for the year or years listed on the request and you are asking DRS for relief from that joint liability. Do not use this form if the issue is a joint refund being applied to your spouse's past-due debt. Use Form CT-8379 for a Connecticut nonobligated spouse claim instead.

Do I attach Form CT-8857 to my Connecticut return?

No. Connecticut DRS says not to file Form CT-8857 with your tax return. Mail Form CT-8857 separately with your statement and supporting information, if applicable. The form will not be considered complete unless you answer all questions in Part 6 and sign and date the request in Part 7.

What should I attach to Form CT-8857?

Attach a statement explaining why you qualify for relief. Include your name and Social Security Number on any additional sheets. If you filed federal Form 8857, the Connecticut form also asks for the status of that federal request and may require a copy of the IRS final determination notice.

Will Connecticut DRS notify my spouse or former spouse?

Yes. The Form CT-8857 instructions say Connecticut law requires DRS to inform your spouse or former spouse of the request for relief. DRS must also allow that person to provide information that may help determine the amount of relief from liability.

Is Form CT-8857 the same as Form CT-8379?

No. Form CT-8857 is used to request relief from a Connecticut income tax liability from a joint return. Form CT-8379 is used when a nonobligated spouse wants their share of a joint Connecticut refund separated from the other spouse's debt.
